Lawyers from Bulgaria, Italy and Spain exchanged knowledge on the appliance of the EU Charter of Fundamental Rights
Managing Partner att. Stefaniya Gicheva was among the ten Bulgarian attorneys at law selected to participate during a three-day international training seminar on the implementation of the EU Charter of Fundamental Rights, which happened on February 20-22, 2020 in Court of Justice in Milan, Italy. The seminar aimed to market knowledge of European human rights law and to research the appliance of the EU Charter of Fundamental Rights at national level. As well, the seminar focused on the key role of human rights lawyers. The event is a component of the Lawyers4Rights Project, which is travel by the Bulgarian Lawyers for Human Rights Foundation in partnership with the Italian Federation of Liberal Professionals (Confprofessioni), the Italian Association of Lawyers (Associazione nazionale forense, ANF), the Milan Bar Association, the University of Burgos (Spain) and therefore the General Council of Spanish Lawyers (Consejo General de la Abogacia Española).

Charter of Fundamental Rights

The workshop focused on two main topics: family reunification and anti-terrorism, analyzing the ecu legal framework and therefore the case law of the courts within the European Union . An analysis of Italian case-law on the implementation of the EU Charter of Fundamental Rights was also presented. On the primary day, the seminar was theoretical and within the other two practical issues were discussed thorough .

The training for lawyers from Bulgaria, Italy and Spain was opened by Mrs Tanya Dimitrova – Consul General of Bulgaria in Milan. the primary day addressed the relevant aspects of the EU Charter of Fundamental Rights with lecturers – attorneys at the Milan Bar Association, including att. Sylvia Belloni – Coordinator of the Human Rights Commission at AC Milan and Attorney-at-Law. att. Cinzia Calabrese, member of the Milan Bar Association, coordinator of the ecu Union Commission.

The topic of the second day’s training was Immigration Law – protection of minors and family reunification. Among the speakers were att. Vinicio Nardo – President of the Milan Bar Association, Dilyana Markova – CEO of the Lawyers4Rights Project, lawyer at Sofia Bar Association, att. Maria Gancheva – Head of Communication Policy for Lawyers4Rights Project, prof. Alessia Di Pascale – Professor at University of Milan and prof. Giulia Tiberi – Professor at Insubria University, also as practicing attorneys, members of Milan Bar Association.

The third day of the training was dedicated to the subject “Terrorism – the rights of suspects and defendants within the course of investigations” with speakers: Stefano Dambruso – Judge, Prof. Emilio De Capitani – executive of the ecu Fundamental Rights Expert Group, Att. Mathia Ferrero – Member of the Human Rights Committee at the AC Milan, lawyer Alessandro Provera – Researcher at Alta Scuola “Federico Stella”, Cattolica University and att. Paola Regina – Attorney at Law in Milan, law of nations Specialist.

During the training, the participants took part within the presentation of a special project – DECALOGUE, a Bulgarian-Italian guide for lawyers assisting citizens suffering from violence, which happened on February 20, 2020 at the Consulate General of Bulgaria in Milan. The Decalogue has practically assisted both lawyers from Bulgaria and Italy, also as all other professionally involved actors within the fight against violence. This publication is additionally helpful for the Bulgarian citizens who have suffered from all sorts of violence and attacks on the individual.

Lawyers from Bulgaria, Italy and Spain will still exchange knowledge on the implementation of the Charter of Fundamental Rights of the ecu Union and to use this European act as a basis for shielding citizens’ rights.

Rental accept Bulgaria
Under the rental accept Bulgaria the lessor (or the landlord) provides to the lessee (or the tenant) the proper to use the property for a specified term, and therefore the lessee – to pay him the agreed rental price.

According to the Bulgarian law, even an oral rental agreement is valid. It is, however, strongly recommended to conclude the rental agreement in writing.

In case of economic lease contract the verification of signatures by a notary and therefore the registration of the contract with the Property Register also are advisable. The advantage of such registration is that the contract remains valid and binding for the new landlord for the term stated in it in event of transfer of the property.

The only exception to the above is an agricultural lease contract. A written form with certification of signatures by a notary is required for its validity. As well, these contracts must be registered with the Property Register and within the local Agriculture Municipal Office.

Usually, the tenant pays the rent for the primary month and a deposit in amount of 1 month’s rent at the time of the signing of the contract. When the contract expires the deposit must be refunded to the tenant. just in case that there are any outstanding obligations of the tenant (i.e. unpaid electricity and water bills for the property), the lessor keeps the deposit and use it to hide these.

The parties also can stipulate a provision for the revision of the rental price (i.e. the changes within the inflation index, changes within the rental market prices, etc.).

The tax on income is 10%.
